POR20 on Vietnamese pangasius fillets exported to the U.S.: Several exporters be exempted

According to the DOC’s preliminary findings for POR20, a number of Vietnamese exporters, including Bien Dong Seafood and Vinh Hoan Corp, were found not to have dumped their products in the U.S. market. Therefore, these companies will not face any anti-dumping duties. Eight companies are eligible for separate tax rates, including Vinh Hoan Corp, Bien Dong Seafood, Can Tho Import-Export Seafood Joint Stock Company (CASEAMEX), Dai Thanh Seafood Co., Ltd, Dong A Seafood One Member Co., Ltd (DONG A SEAFOOD), Hung Ca 6 Company, Nam Viet Corporation (NAVICO), and NTSF Seafoods Joint Stock Company (NTSF SEAFOODS).

Since the U.S. considers Vietnam a non-market economy, the DOC uses data from third countries to calculate dumping margins for Vietnam. For this review, Indonesia was chosen as the surrogate country to calculate the margin, based on factors such as: (1) Indonesia’s economic similarity to Vietnam, (2) its significant production of goods similar to those under investigation, and (3) the availability of reliable and usable data from Indonesia to evaluate Vietnam’s production factors.

The DOC is expected to issue its final anti-dumping duty results 120 days after the release of the preliminary findings.
