The Goverment requests to maximize pecuniary penalty on violated fishing boat up to tenfold
The new issued Decree stipulates one billion dong of pecuniary penalty on individuals committed to contravention of seafood activities (while it was 100 hundred million dong in Decree 103/2013)
According to Vietnam Association of Exporters and Producers, Decree 103/2013 is replaced with Decree 42/2019, which regulates administrative penalty in fisheries industry and become effective on 05 July.
The new issued Decree maximizes pecuniary penalty on administrative contravention of seafood regulations up to one billion dong (it was 100 hundred million dong in Decree 103/2013).
If organizations commit to contravention of seafood activities, the administrative penalty is two billion dong. The new issued Decree stipulates more details of eight administrative contraventions, penalty method, and countermeasures.
Particularly, penalty of between 800 million dong and one billion dong for fishing boat owners committed to these contraventions.
Owners of boats at least 24m long operating within Vietnam’s water area with expired fish exploitation licenses or without licenses.
Owners of fishing boats operating in national water area, foreign sovereign or water area under management of local fisheries organization, with expired fish exploitation licenses or expired approval paper or without licenses or approval paper.
Foreign fishing boats operating in Vietnam’s water area with expired fish exploitation licenses or without licenses.
Besides, some supplement contravention methods include confiscation of exploited seafood or fishing boats and confiscation of exploitation licenses in 6-12 months.
Foreign fishing boat owner will be requested to pay the cost of taking the crew to their home country and pecuniary penalty for his contravention.
